Accommodation Clause MUWA NISEKO (2023.03.28)


Article 1 Scope of Application
1.    The accommodation contract and related agreements entered into by the Hotel and the guest shall be governed by the Accommodation Clause and the Terms of Use, and any matter not provided for the Accommodation Clause or the Terms of Use shall be governed by Japanese laws or generally established customs in Japan.
2.    In the event that the Hotel agrees to a special agreement to the extent that it does not contravene Japanese laws, regulations, and customs, such special agreement shall prevail over Article 1.1.
3.    The Hotel reserves the right to apply different Terms of Use to products, campaigns, and promotions sold through travel agencies (including online travel agencies).

Article 2 Reserving accommodation
1.    A person who wishes to reserve an accommodation at the Hotel is requested to provide the following information to the Hotel: 
      1. Full name of the main guest
      2. Dates of the stay
      3. Estimated time of arrival
      4. Number in the party
      5. Age(s) of the guests staying(age of any minor in the party as bath tax of Kutchan-cho are due depending on the age)
      6. Room type
      7. Contact information of the main guest
      8. Any other items deemed necessary by the hotel

2.    In the event of any change to the details of the guest provided in Article 2.1, the guest must notify the Hotel of such change as soon as possible.
      1.    Changes include, but are not limited to, names, number in the party, dates of stay, number of nights, package upgrades/downgrades, and additional items.
      2.    Upgrade/downgrade to the reservation are deemed as change of details and are subject to availability.
      3.    The Hotel reserves the right to upgrade or change to a comparable standard of accommodation at any time.
      4.    In the event that the guest notifies a change, the Hotel shall process this as a new reservation. If the change is requested during the no cancellation period, it shall be considered a cancellation and the cancellation policy shall take precedence.

Article 3 Establishing the Accommodation Contract, etc.
1.    The accommodation contract shall be concluded when the Hotel accepts the reservation as stated in Article 2 and the deposit as stated in Article 4 is paid. However, this shall not apply when the Hotel proves that it did not authorize the reservation. In the event that payment of the deposit as stated in Article 4 is not required, the accommodation contract shall become effective when the Hotel authorizes the reservation and a reservation confirmation is issued.
2.    When an accommodation contract has been concluded pursuant to Article 3.1, a deposit as specified by the Hotel in Article 4 shall be paid by the date specified by the Hotel.
3.    The deposit shall be allotted to the room charge ultimately payable by the guest, and if a situation arises in which the provisions of Articles 6, 7 or 11 apply, a penalty then a compensation shall be paid. If there is a remaining balance, and any remaining amount shall be returned upon payment of the charges pursuant to Article 14.
4.    If the deposit is not paid by the date specified by the Hotel as stated in 3.2, the accommodation contract shall cease to be effective except in the event that the Hotel failed to notify the guest of the deposit payment due date.

Article 4 Deposit
1.    Unless otherwise stated in the accommodation plan, the deposit and the room charge payable by the guest shall be the amount specified for the following categories:
       1.  Summer Accommodation Contract (from April 1 to November 30) 
             1.1. Reservations for 1 to 14 nights for 4 rooms or less: 
             1.1.1. The room charges must be paid in full at check-in. No deposit is required.   
                       Reservations are confirmed upon issuance of a reservation confirmation. 
            1.2.  Reservations for 15 nights for 5 rooms or more: 
            1.2.1. Reservations made at least 8 days prior to arrival: 
            1.2.1.1. A deposit equal to 20% of the total room charge must be paid within 3 days of the reservation request date.
                        The reservation is confirmed upon payment of the deposit. 
            1.2.1.2. The balance of the total room charge must be paid 7 days prior to arrival.
            1.2.2. Reservations made less than 7 days prior to arrival: 
            1.2.2.1. The total room charge must be paid in full at reservation. 
                        The reservation is confirmed upon such payment. 
      2. Winter Accommodation Contract (from December 1 to March 31): 
            2.1. The total room charge must be paid in full at reservation. 
                  The reservation is confirmed upon such payment.
2.    If a guest makes multiple reservations, the preceding conditions will apply based on the total number of nights for all the reservations.
3.    The deposit must be paid with a credit card to confirm the reservation. The amount of the deposit is as stated in 3.1.
4.    In the event that the payment stated in 3.1 and/or 3.2 are not received by the respective due dates, the accommodation contract shall be deemed to have been cancelled by the guest.
5.    All payments are to be paid in Japanese yen. Amounts shown in other currencies are approximations and will be confirmed by the credit card company upon completion of payment. The Hotel is not liable for any difference in exchange rates between Japanese yen and other currencies.
6.    Except in a case where all room charges are to paid at check-in, all payment must be made by credit card only.
7.    Unless otherwise specified, all taxes, including bath tax and accommodation tax, are included in the room rate. The amount and rates for these taxes are subject to change without notice. Rates, accommodation plan details, the Accommodation Clause, and Terms of Use are subject to change or termination without notice. When such change is made after a reservation has been made, the version at the time of reservation will take precedence throughout that stay.

Article 5. Refusal to confirm an Accommodation Contract
1.    The Hotel may refuse to enter into an accommodation contract in the following cases:
      1.    When the reservation request is not in accordance with the terms set forth in this Accommodation Clause.
      2.    When there is no room available due to full occupancy.
      3.    When there no room availability during disaster or other emergency situation where the Hotel must prioritize providing the rooms for disaster victims and disaster recovery personnel.
      4.    When the person who intends to stay at the hotel is a member or related party of a crime syndicate, a group affiliated with a crime syndicate, or any other antisocial force as defined in the Law Concerning Prevention of Unjust Acts by Members of Crime Syndicates and Prefectural Ordinances Concerning the Elimination of Crime Syndicates.
      5.    When the person who intends to stay at the Hotel is likely to commit an act contrary to the provisions of laws and regulations, public order, or good morals in connection with the stay.
      6.    When it is clearly confirmed that the person who intends to stay is suffering from a communicable disease.
      7.    When the Hotel is requested to provide services or other arrangements that exceed the socially acceptable range in relation to the stay.
      8.    When it is impossible to accommodate guests due to natural disasters, breakdown of facilities, or other unavoidable circumstances.
      9.    When a person who intends to stay at the Hotel is intoxicated or otherwise likely to cause inconvenience to other guests, interfere with the operation of the Hotel, or behaves physically or verbally in a way that causes significant inconvenience to other guests or to the Hotel staff.
      10.    When a person who intends to stay is clearly in a state of mental or physical difficulty.
      11.    When the person(s) in the party are minors without parental permission to stay.
      12.    When the reservation is made with the intention of transferring the right to stay in the room to another person.
      13.    When a guest makes a reservation with no intent to stay at the Hotel.
      14.    Any other circumstances that fall under the provisions of various laws and regulations or prefectural ordinances, etc.

Article 6 Right of the Guest to Cancel the Contract
1.    The guest may cancel the accommodation contract by making a request to the Hotel.
2.    Cancellation of the accommodation contract includes change of accommodation facility or unit, room type, check-in date, or check-out date.
3.    In the event that a guest cancels all or part of the accommodation contract due to reasons attributable to the guest (except in the event that the request to cancel was before the payment due date as specified by the Hotel pursuant to 3.2), the Hotel shall charge a penalty (cancellation fee) as listed in Appended Table 2. 
4.    In the event that the guest has not contacted the Hotel and has not arrived at the scheduled time of arrival, the Hotel may treat the accommodation contract as having been cancelled by the guest.

Article 7 Right of the Hotel to Cancel the Contract
1.    The Hotel may cancel the accommodation contract in the following cases:
      1.    When a staying guest is a member or associated person of a crime syndicate, a group affiliated with a crime syndicate, or any other antisocial force as defined in the Law Concerning Prevention of Unjust Acts by Members of Crime Syndicates and Prefectural Ordinances Concerning Elimination of Crime Syndicates.
      2.    When a staying guest commits or is likely to commit an assault, threat, extortion, unreasonable demand, gamble, or in possession or use of drugs, firearms, swords, and similar items not permitted by law, acts that cause inconvenience to other guests, or other acts contrary to laws and regulations or public order and morals in the Hotel.
      3.    When it is clearly confirmed that the staying guest is suffering from a communicable disease.
      4.    When the Hotel is requested to provide services or other arrangements that exceed the socially acceptable range in relation to the stay.
      5.    When it is impossible to accommodate guests due to natural disasters, breakdown of facilities, or other unavoidable reasons.
      6.    When a guest commits an act that interferes with fire prevention and protection, such as smoking in the Hotel, tampering with firefighting equipment, etc.
      7.    When a person transfers or attempts to transfer the right to stay at the accommodation.
      8.    When the accommodation contract has been concluded through a travel agency but the payment has yet to be confirmed by the Hotel.
      9.    When a guest violates the Terms of Use as set forth by the Hotel.
      10.    Any circumstances which allows the Hotel to refuse accommodation under applicable laws and regulations or prefectural ordinances, etc.
2.    Notice of cancellation pursuant to 7.1 shall be given orally, or by telephone, e-mail or in writing to the contact details provided by the guest pursuant to Article 2. If such notice does not reach the guest via the contact details provided, the notice shall be deemed to have reached the guest when the period during which it should normally reach the guest has elapsed.
3.    When the Hotel cancels the accommodation contract pursuant to the 7.1 or 7.2, the accommodation payment will not be refunded, except in the case of 7.1.3 and 7.1.5.

Article 8 Accommodation Registration
1.    Guests are required to register the following at the front desk of the Hotel at check-in:
      1.    Name, age, gender, address and occupation of the guest
      2.    For foreigners, nationality, passport number, copy of passport, previous and subsequent place of stay, and a valid credit card.
      3.    Departure date and scheduled departure time
      4.    Other matters deemed necessary by the Hotel
2.    When a guest intends to pay the charges by a method other than cash such as an accommodation voucher or a credit card, the guest must present such method in advance at the time of check-in.
3.    Upon check-in, the Hotel requests guests to provide a credit card to guarantee     any payment that arises during the stay. Guests will not be allowed into the guest rooms before such credit card details are confirmed and check-in completed.

Article 9. Usage Time of the Guest Rooms
1.    Guests may use the guest rooms from 1500 check-in to 1000 check-out. When a guest is staying for multiple days, the room will be available for the entire day, except for the day of arrival and the day of departure. However, this does not apply when changing rooms.
2.    If the room is not vacated by the check-out time, a predetermined late check-out fee will be charged.
3.    Notwithstanding 9.1 and 9.2, the Hotel may approve the use of a room outside the hours specified. In such cases, an additional charge as determined by the Hotel will be charged.
4.    Even during the time when a guest may use a guest room in accordance with 9.1, 9.2, and 9.3, the Hotel may enter the guest room and take necessary measures for reasons of safety, hygiene management, or other operational management.

Article 10 Cleaning of Guest Rooms
1.    When a guest stays in the same room for two or more consecutive nights, the cleaning cycle will be as follows:
[simple cleaning on days 2 and 3, regular cleaning on day 4, and then back to the start of the cycle].
A guest may request for additional cleaning other than this cleaning cycle, by paying the pre-determined fee.
2.    The Hotel reserves the right to clean the room outside of the cleaning cycle if it deems necessary.
3.    The guest shall not be able to refuse the cleaning of the guest room as described in 10.2.

Article 11 Liability of Guests
1.    The guest indemnifies the Hotel for the expenses and damages it incurs for cleaning and repairing guest rooms, lost sales opportunities, or due to any other act by a guest in violation of the Accommodation Clause or the Terms of Use or for any other reason attributable to the guest.
2.    The Hotel requires a valid credit card to guarantee a guest’s stay.
3.    In accordance with the regulations, the guest agrees that all payment invoiced by the Hotel shall be processed with the credit card registered at check-in.

Article 12 Compliance with Terms of Use
Guests shall abide by the Terms of Use established by the Hotel during their stay.

Article 13 Business Hours
1.    The main hours of operation of the various facilities can be found in the hotel pamphlet, notices posted in various locations, and in-room service directory.
2.    The hours of operation of the facilities may change temporarily when deemed unavoidable which will be notified accordingly.

Article 14 Payment of Charges
1.    The breakdown and the method of calculation of accommodation charges, to be paid by the guest are shown in Appended Table 1.
2.    Payment of the accommodation charge, etc. as set forth in 14.1 shall be made in cash or by alternative methods including accommodation vouchers or credit cards accepted by the Hotel, at the time of arrival of the guest or when requested by the Hotel.
3.    The guest must pay for the accommodation charges if the guest voluntarily decides not to stay after the room being made available, regardless of the guest being at fault for the decision.

Article 15. Failure to Provide Contracted Rooms
1.    In the event that the Hotel is unable to provide the guest with the contracted room, with the approval of the guest, the Hotel shall make the best effort to offer an alternative accommodation of the same condition.
2.    If the Hotel is unable to offer an alternative accommodation as defined in 15.1, it must compensate the guest for the amount in accordance with the penalty list in Appended Table 2. However, if the reason for the unavailability is not attributable to the Hotel, no compensation will be paid.

Article 16 Handling of Personal Possessions
1.    Please keep your luggage in your guest room. Each room is equipped with a safe.
2.    The Hotel is not responsible for any personal belongings, valuables, or cash brought into the Hotel by guests. The guests are responsible for securing their valuables in the safe in the guest room.
3.    In the event of loss or damage of articles, cash, or valuables left with the front desk by a guest prior to check-in or after check-out, the Hotel shall compensate for such damage, except in the event of force majeure. However, the Hotel shall not compensate for the loss or damage of cash or valuables which the guest failed to inform the type/nature or the amount of despite such information being requested by the Hotel.

Article 17 Custody of Luggage or Personal Effects of Guests
1.    If a guest's baggage arrives at the Hotel prior to his/her stay, it will be stored responsibly only when the Hotel is notified prior to arrival and agrees and will be handed over to the guest at check-in. However, the maximum days for storing such luggage shall be 7 days before the planned check-in and 7 days after check-out. The luggage that arrives in advance must not contain cash, valuables, perishable items, living creatures, or items that emit unusual noise or odor.
2.    If a guest's baggage or personal belongings are found to have been left behind after the guest had checked out, the hotel will, in principle, keep the luggage for 7 days from the day it was found.
In addition, food, beverages, magazines, and other items deemed as waste by the Hotel shall be disposed of at its discretion after check-out.

Article 18 Personal Belongings when Using the Communal Bath
1.    When using the communal bath, any personal belongings are to be stored in lockers in accordance with the instruction provided.
2.    The Hotel shall not be liable for any damage caused by theft or unauthorized use of the room key by a third party due to failure to comply with 18.1 such as bathing with valuables and the room key left in the changing basket.

Article 19 No Smoking
1.    Smoking is prohibited throughout the Hotel(including balconies and terraces). (Smoking area outside the hotel are not covered.) In the unlikely event that a guest or guest's companion is found smoking (cigarettes, e-cigarettes, cigars, etc.) inside the hotel or on the balcony/terrace and fails to stop smoking despite receiving a warning, the guest and the companion may be asked to leave the premises. No refunds will be made in such cases.

2.    In the unlikely event that a guest or companion is found to be smoking in the guest room, an additional cleaning fee will be charged. In addition, any costs from any inconvenience experienced by the next guest including deodorization or arranging an alternative guest room will be invoiced and paid for in accordance with Article 11.

Article 20 Liability of the Hotel
1.    The Hotel will compensate for any damages to the guest in its performance or failure to perform in accordance with the Accommodation Contract and related agreements. However, this shall not apply if the damage is not caused by reasons attributable to the Hotel.
2.    The hotel is insured in the event of fire, etc.

Article 21 Liability for Parking
1.    When a guest uses the hotel car park, the Hotel is merely renting out a space for parking and will not be held responsible for the storage of the vehicle.
However, if the Hotel intentionally or negligently causes damage in the management of the parking lot, the Hotel shall be liable for such damage.

Article 22 Travel Insurance and Obligations of Guests
1.    The Hotel operates only in Japan and all services are provided in accordance with the laws of Japan. While some services are provided by agencies, reservations are accepted only in accordance with the Terms of Use as set forth by the agency or the Hotel.
2.    In accordance with the law, the Hotel shall not be liable for any loss, damage, delay, delay in flight, indirect damage, injury or death, except for reasons attributable to the Hotel.
3.    The Hotel recommends guests to take out appropriate travel insurance to cover any unforeseen circumstances that may arise after your reservation is confirmed. By using the Hotel, you agree to assume all such risks.

Article 23 Revision of the General Terms and Conditions
The general terms and conditions in the Accommodation Clause may be revised as necessary.
If and when these terms and conditions are revised, the Hotel shall post the revised terms and conditions and their effective date on the Hotel's website or in the guest room.

*Conversion rates and fees for cancellations and refunds vary by credit card companies and banks. The guest is responsible for the bank transfer fees for refunds.

[Special Provisions]
Even in cases subject to penalty fee (cancellation fee) as described, the penalty fee (cancellation fee) may be waived if the following conditions are met:
1. At any point between the check-in and check-out dates, the guest is unable to travel to Japan due border closures caused by COVID-19 or other epidemic and has an official document (such as an airline notification) to prove this fact.

2. If cancellation is requested pursuant to the reason in item 1, 30 days prior to the check-in date during the winter season (December 1 to March 31).

3. If cancellation is requested pursuant to the reason in item 1, 5 days prior to the check-in date during the summer season (April 1 to November 30)

4. The Special Provisions only apply to the cancellation pursuant to the aforementioned items and the Hotel strongly recommends that all guests take out travel insurance as it assumes no liability for trip cancellations for any other cases.


Terms of Use MUWA NISEKO (2023.03.28)

In order to ensure the safety and comfort of our guests and to maintain the public nature of our accommodation facilities, the Hotel has established the following rules, which are integral to the Accommodation Clause. In the event of a violation of these rules, the accommodation contract may be cancelled in accordance with Article 7 of the Accommodation Clause.

Additional charge for after-hours use of guest rooms
The Hotel has set the time for check-in at 1500 and check-out time at 1000.
Additional charges as defined in Article 9.2 of the Accommodation Clause shall be as follows. However, late check-out is subject to room availability.

1.    Overtime 
20% of room charge until 1200
100% of room charge for after 1200
2.    Extended stay (before check-in time)
100% of room charge before 1500

Number of Guests in the Guest Room
In principle, the use of the guest room by more than the number of guests specified is prohibited.
In the event that a guest is found to be using a guest room in excess of the number of staying guests declared, excess usage will be charged to the guest.

Pets
Pets are not allowed to stay at the hotel.
Guide dogs, service dogs, and hearing dogs are allowed in accordance with the Assistance Dogs for the Physically Challenged Act.

Car Park
1.    The guest is requested to park their car in the designated lot. The number of parking spaces is limited.
2.    It is illegal to park on the street in the vicinity of the hotel. Please refrain from doing so or it may be towed.
3.    In principle, guests may use the parking space from check-in to check-out as determined by the Hotel.
4.    In principle, car washing on the premises is prohibited.

Misplacing a Room Key
In case of loss of a room key, 2,000 yen will be charged for the cost of reissuing a card key.
The following acts are strictly prohibited in the guest rooms.
1.    Use not for the purpose of lodging.
2.    Posting photographs/posters or hanging laundry/bedding/other items on guest room windows, balconies, terraces, private gardens, etc. which detracts from the appearance of the Hotel
3.    Use of fireworks, barbecues, or similar fire hazards on balconies, terraces, private gardens, etc.

The following acts are strictly prohibited in the Hotel.
1.    Use of flammable devices for heating or cooking as well as pressing irons and other electrical appliances not on loan from the Hotel.
2.    Any boisterous act such as singing or chanting, emission of foul odors, or any other behavior that may cause displeasure or annoyance to a third party.
3.    Bringing in the following items onto the Hotel premises.
      1.    Animals, birds, etc. (excluding guide dogs, etc.)
      2.    Any illegal drugs including methamphetamine and narcotics
      3.    Explosives, volatile oils, and other chemicals that may ignite or catch fire or cause bodily harm
      4.    Firearms, swords and similar items without a permit
      5.    Items in significantly large quantity or weight
      6.    Items that emit a foul odor
      7.    Waste or items that interfere with guest room hygiene
      8.    Electrical appliances, cooking utensils and other items intended for use in the Hotel
      9.    Other items prohibited by the Hotel
4.    Acts that are offensive to public order and moral.
5.    Distributing flyers, leaflets or other advertising materials to other guests.
6.    Moving, altering, removing, or using for purposes other than the original intent of various facilities and items which are the properties of the Hotel.
7.    Leaving personal belongings outside of the guest room.
8.    Entry into areas where guests are prohibited. (except in the case of an emergency or under unavoidable circumstances)
9.    Taking delivery of food and beverages from facilities other than those approved by the Hotel.
10.    Use of hair dye, bleach, etc. in bathrooms inside the guest rooms or the communal bath area.
11.    Burning incense, etc. in the guest room.
12.    Activities that generate profit.
13.    All other activities that interfere with the safety and hygiene of the Hotel.
